So Qualcomm has already cashed in twice! The same opinion now comes from a Federal judge:<\/p>\n<p>According to a new report from Reuters, a U.S. federal judge has issued a preliminary ruling in March 14<sup>th<\/sup> that Qualcomm must pay Apple nearly $1 billion in patent royalty rebate payments. So that being stated, it&#8217;s not Apple who owes Qualcomm, instead it&#8217;s Qualcomm who owes Apple and 1 billion us$ is no small amount. The ruling comes from Judge Gonzalo Curiel of the U.S. District Court for the Southern District of California. Although the ruling is set, this is not the final statement and it&#8217;s most likely that Qualcomm will fight back to avoid paying this large sum to Apple!<\/p>\n<p>As Reuters explains, contract factories that build the iPhone generally paid Qualcomm \u201cbillions of dollars per year\u201d to use Qualcomm\u2019s patented technology in the iPhone. In turn, Apple would reimburse the factories. Further, Qualcomm and Apple had a separate agreement that would see Qualcomm pay Apple \u201ca rebate on the iPhone patent payments if Apple agreed not to attack in court or with regulators.\u201d<\/p>\n<p>Two years ago, Apple sued Qualcomm and claimed that the chip maker had breached the agreement by not paying the patent royalty rebates. Qualcomm, however, said it stopped paying the rebates because Apple encouraged other smartphone makers to \u201ccomplain to regulators\u201d and made \u201cfalse and misleading\u201d statements to the Korean Fair Trade Commission.<\/p>\n<p>This was the statement for Apple&#8217;s lawsuit:<\/p>\n<div class=\"post_quote\">Apple is suing Qualcomm for roughly $1 billion, saying Qualcomm has been \u201ccharging royalties for technologies they have nothing to do with.\u201d [\u2026] Apple says that Qualcomm has taken \u201cradical steps,\u201d including \u201cwithholding nearly $1 billion in payments from Apple as retaliation for responding truthfully to law enforcement agencies investigating them.\u201d<\/div>\n<p>And this is the debate of the FTC:<\/p>\n<div class=\"post_quote\">The Korea Fair Trade Commission said Qualcomm abused its dominant market position and forced handset makers to pay royalties for an unnecessarily broad set of patents as part of sales of its modem chips.<\/p>\n<p>The U.S. firm also hindered competition by refusing or limiting licensing of its standard essential patents for modem chips to rival chipmakers, the regulator said.<\/p><\/div>\n<p>In this case however, Judge Curiel came down on Apple\u2019s side, ruling that Qualcomm must pay Apple the missed patent rebate payments. In a statement, Apple said, \u201cQualcomm\u2019s illegal business practices are harming Apple and the entire industry.\u201d<\/p>\n<p>All in all this is for sure not the last we have seen in the everlasting fight between Qualcomm and Apple.
